Clear Channel Broadcasting, Inc., its subsidiaries and affiliated companies
(together, the "Company"), will conduct the Contest in the Station's Designated Market Area (as defined by Nielsen) substantially as described in these rules,
and by participating, each participant agrees as follows: 1. Description of Contest/Participation A. Dates of Contest The Contest will begin on or about March 1, 2008 and end
on or about June 30, 2008.

B. How to Enter and Play: NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. PURCHASE DOES NOT INCREASE CHANCE OF WINNING. VOID WHERE PROHIBITED. ODDS OF WINNING DEPEND UPON THE NUMBER OF PARTICIPANTS.
Your e-mail address will be used to identify you. Log on to the Station's
website; click on the Melody Magic Challenge icon and register by completing all the
required information including a valid US postal address and home phone number.
You can play every week during the course of the Contest, however you may only
enter one time each week. Users who play under multiple accounts for this game are not elgible to win prizes.
Once registered, log-on and make your selection for the Melody Magic team
that will be eliminated from the show that week. Additionally, when you initially
register, you will be asked to pick a winning team of The Melody Magic Challenge. Episode picks must
be made prior to 5 PM Eastern on the day of the show. Players may alter their
picks up until 5 PM Eastern on the day of the show. Please note that any episode
pick(s) left blank in any given week will be automatically entered as incorrect answer
and no points will be awarded. To avoid this you must pick every episode. If any
team on the show is disqualified and the player picked them to be eliminated, it
will be judged as a correct pick. |

Please note that the contest will end before
the final episode of the show airs. As a result, points will not
be awarded for the last two shows. Points are the number of points they earn if the player guesses correctly as
to which team is eliminated off the show, according to the show's rules. The point system is
based on the number of teams on the show at the start of the episode. The
winner will be determined based on total points accumulated as of June 30, 2008. 2) In the event of a tie in total points accumulated by the player during the
Melody Magic Challenge, we use the following criteria: When the player initially
registered for the game, they were asked to pick a winning team for Melody Magic.
The player will be awarded 1 point per week as long as the team they picked
is still in the game. If a tie still exists in adding up the most accumulated
points, then a random drawing will be conducted to determine the winner. THE CONTEST IS FOR ENTERTAINMENT PURPOSES ONLY AND MAY NOT BE USED IN
CONNECTION WITH ANY FORM OF GAMBLING. THIS GAME IS NOT AFFILIATED WITH OR SPONSORED BY ABC INC., ETC. In the event that the Melody Magic Show is postponed, terminated early,
or cancelled for any reason (such as a strike or lockout), the Station reserves
the right to award prizes based on scores at the time the season is disrupted,
or to cancel, modify or suspend the Contest at its discretion. |
2. Prize(s) The prizes that may be awarded to the eligible winners are:
The weekly first place winner will receive a four pack of tickets to Six Flags ($100 value) and a $5 gift card for SUBWAY restaurant ($5 value).
In the event of a tie between weekly first place winners, we will look at the total points the player estimates for the specified tiebreak game. The player with the closest estimate without going over will be that weeks first place winner. In case there is a tie after total wins and total tie break points for a week, then the first place winner will be selected in a random drawing from all eligible tie score contestants.
If a winner is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner's prize, in its sole discretion. All prizewinners' names will be posted on the participating Stations' websites. Winners will also be notified by email. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
3. Eligibility and Limitations Participants and winner(s) must be U.S. residents at least 18-years old as
determined by the Company, have a valid email address and live within in the
Station's Designated Market Area (as defined by Nielsen). Only one (1) prize per household within any thirty (30) day period. Employees
of the Company, the Contest's participating sponsors and their advertising
agencies, employees of other radio or television stations, and members of
the immediate family of any such persons are not eligible to participate
and win. The term "immediate family" includes spouses, siblings, parents,
children, grandparents, and grandchildren, whether as "in-laws," or by
current or past marriage(s), remarriage(s), adoption, co-habitation or
other family extension, and any other persons residing at the same household
whether or not related. In the event of a dispute about the identity of
any entrant, entries made online will be declared made by the authorized
account holder of the e-mail address submitted at time of entry. "Authorized
account holder" is defined as the natural person who is assigned to an
e-mail address by an Internet access provider, online service provider or
other organization that is responsible for assigning e-mail addresses for
the domain associated with the submitted e-mail address. A potential winner
may be required to provide the sponsors with proof that the potential winner
is the authorized account holder of the e-mail address associated with the
winning entry.
4. Delivery Disclaimer The Company disclaims all liability for any delays, misdelivery, loss, or
failure in the delivery of any item sent by mail, courier, express,
electronic transmission, or other delivery method. The Company is not
responsible for mechanical, technical, electronic, communications, telephone,
computer, hardware or software errors, malfunctions or failures of any kind,
including: failed, incomplete, garbled or delayed transmission of online
entries, traffic congestion on telephone lines, the Internet or at any
website or lost or unavailable network connections which may limit an online
entrant's ability to participate in the Contest, and any injury or damage
to entrant's or any other person's computer related to or resulting from
participating in or downloading any information necessary to participate in
the Contest.
5. Publicity; Use of Personal Information By participating, where allowed by law, all participants and winner(s) grant
the Company exclusive permission to use their names, characters, photographs,
voices, and likenesses in connection with promotion of this and other
contests and waive any claims to royalty, right, or remuneration for such use.
By participating in the Contest, where allowed by law, participants agree
that the Company may disclose personal information obtained from participants
in the Contest to third parties and use such information for marketing and
other purposes.
6. Release By participating in the Contest, each participant and winner waives any and
all claims of liability against the Company, its employees and agents, the
Contests sponsors and their respective employees and agents, for any personal
injury or loss which may occur from the conduct of, or participation in, the
Contest, or from the use of any prize. In order to receive a prize,
participants must sign an official waiver form provided by the Company.
7. Taxes Any valuation of the prize(s) stated above is based on available
information provided to the Company, and the value of any prize awarded to
a winner may be reported for tax purposes as required by law. Each winner
is solely responsible for reporting and paying any and all applicable taxes
related to the prize(s) and paying any expenses associated with any prize
which are not specifically provided for in the official rules. Each winner
must provide the Company with valid identification and a valid taxpayer
identification number or social security number before any prize will be
awarded. Prizes are not transferable, redeemable for cash or exchangeable
for any other prize. Any person winning over $600 in prizes from a station
will receive an IRS form 1099 at the end of the calendar year and a copy of
such form will be filed with the IRS.
8. Decisions By participating in the Contest, participants agree to be bound by the
decisions of Company personnel. Persons who violate any rule, gain unfair
advantage in participating in the Contest, or obtain winner status using
fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying,
harassing or threatening behavior is prohibited. The Company will interpret
these rules and resolve any disputes, conflicting claims or ambiguities
concerning the rules or the Contest and the Company's decisions concerning
such disputes shall be final. If the conduct or outcome of the Contest is
affected by human error, any mechanical malfunctions or failures of any kind,
intentional interference or any event beyond the control of the Company,
the Company reserves the right to terminate this Contest, or make such other
decisions regarding the outcome as the Company deems appropriate. All
decisions will be made by the Company and are final. The Company may waive
any of these rules in its sole discretion. Any and all improprieties should
be reported immediately to
cctvi@clearchannel.com. The Company
reserves the right at their sole discretion, to disqualify any individual who
violates these rules, tampers with the entry process, or engages in any
conduct detrimental to Stations, the Contest or any other entrant (in each
case as determined in Station's sole discretion), to lock out any individual
whose eligibility is in question, and to cancel, terminate, modify or
suspend this Contest at any time. CAUTION: ANY ATTEMPT BY ANY PERSON TO
DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF
THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN
ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK FROM ANY SUCH PERSON
DAMAGES AND ANY OTHER REMEDIES AVAILABLE TO THE COMPANY TO THE FULLEST EXTENT
PERMITTED BY LAW.
9. Miscellaneous Each winner must submit proof of eligibility and sign the Company's release
form to claim the prize. The Company may substitute prizes, amend the rules
or discontinue the Contest at any time as announced on the Station(s). The
Company disclaims any responsibility to notify participants of any aspect
related to the conduct of the Contest. Written copies of these rules are
available during normal business hours at the business offices of the
Station(s) and by mail upon written request with a stamped, self-addressed
return envelope. All entries become the property of the Company and will
not be returned. To be removed from our direct mail, email or fax lists,
visit the main office of the Station during regular business hours, or send
a self addressed stamped envelope with contest name to My Eyewitness News, 2701 Union Avenue Extended, Memphis, TN 38112.
10. Compliance with Law The conduct of the Contest is governed by the applicable laws of the United
States of America, which take precedence over any rule to the contrary
herein. Station(s) shall follow the applicable laws for conducting contests,
including notice to the state attorney general or consumer affairs office,
posting of a prize bond, furnishing lists of winners, running specific on-air
disclaimers, providing specific written information about the Contest, etc.
as required by local and state law.
